SAN ANTONIO The man who plunged 18 stories to his death early Friday from a downtown hotel had assaulted his wife after she refused to engage in four-way sex with another couple, according to one version of the story his wife told police.

In a report released Tuesday, police identified the man, 46, as Michael A. Ochoa, who friends described as a prominent area real estate agent. The Bexar County Medical Examiner had identified him as Michael Lopez on Saturday evening, but changed their records Tuesday to correct the name.

When police arrived at the Hilton Palacio del Rio hotel just before 2 a.m., Ochoa’s wife was upset and crying. She had scratches on both her arms and her left ring fingernail ripped off, according to police. Her speech was slurred and her breath smelled of alcohol, police said. The woman, who was not identified, told police three different versions of the circumstances surrounding her husband’s death.

In the first version, the couple had decided to have sex in their room with another couple. When the other couple arrived, Ochoa’s wife “had second thoughts,” angering Ochoa, according to the police report.

Ochoa’s wife said the other couple left the room before Ochoa started punching her in the head. Then he walked outside to the balcony and his wife did not see him any more.

Two security guards knocked on the door, then entered when nobody answered. Ochoa’s wife told them her husband was on the balcony, but they didn’t see him there.

In another account, Ochoa’s wife told police that her husband had been fighting with another person in the room – one of the people she originally said the pair was supposed to have sex with. Ochoa’s wife said she tried to intervene, but both people punched her. Both members of the other couple left and Ochoa went to the balcony, his wife said. Security arrived and Ochoa’s wife lost sight of her husband, she said.

When asked again what happened, Ochoa’s wife repeated the first story again, but said her husband was trying to escape security, thinking he was going to be arrested. His wife said she thought Ochoa was trying to climb down the balcony before security came in.

Ochoa’s wife did not know that he had fallen from the balcony and died, according to police.

Security officers told police they heard a splashing sound upon entering the room. Ochoa’s wife was lying on the bed and told officers her husband was out on the balcony, the security officers said. Looking over the balcony, the security officers saw the body in the river.

Officers found Ochoa’s body unresponsive in the river. They pulled him out and laid him on the sidewalk. He had scratches on his back and hips, but officers did not know the extent of injuries to the front of his body.

Police noticed signs of a struggle in Ochoa’s hotel room, but not on the balcony.

In surveillance footage of the other couple leaving the main lobby, they were walking calmly and did not have any noticeable injuries, according to police.

No one was charged in the incident.
